Arizona Exclusive Sale: The sale organized by Arizona Love will take place during each braderie. Items from this sale are offered at rounded prices and cannot be returned or exchanged under any circumstances.

 

www.arizonalove.store (the "Site") is operated by the company Dress Gallery, a simplified joint-stock company (SAS) with a capital of €7,800, whose registered office is located at 5, rue Cambon – 75001 Paris (75001), France, registered with the Paris Trade and Companies Register (R.C.S) under number 508 887 593, intra-community VAT number FR64508887593 ("Dress Gallery").

I - Application of the General Terms and Conditions of Sale

The general terms and conditions of sale (the "GTC") detailed below apply to all orders of products and services placed via the Site (the "Products") with Dress Gallery by any person (the "Client"). Dress Gallery reserves the right to adapt or modify these GTC at any time. The version of the GTC applicable to any sale is the one posted online on www.arizonalove.store at the time of the order. Consequently, placing an order requires the Client’s full and unconditional prior acceptance of these GTC by clicking the button "I have read and accept the general terms and conditions of sale."

II - Information about the Site and Accessibility

www.arizonalove.store is an e-commerce site owned and operated by Dress Gallery. The Site is open to all internet users and is in principle accessible 24/7, except in case of interruptions, scheduled or not, by Dress Gallery or its service providers, for maintenance and/or security reasons or force majeure (as defined below). Dress Gallery cannot be held responsible for any damage resulting from unavailability of the Site. Dress Gallery reserves the right to make changes to the Site for technical or commercial reasons. When these changes do not substantially and negatively affect the conditions of service provision, the Client may be informed but their acceptance is not required.

III - Registration on the Site

To place an order, the Client must first register on the Site by creating an account containing their information (the "Account"). Registration is validated by Dress Gallery after verification of the completed standard form. The Client receives a confirmation email. When creating their account, the Client must ensure that the data provided is accurate and complete and must keep it updated. Dress Gallery cannot be held responsible for delivery failures caused by errors in the recipient’s contact details. By registering, the Client declares and guarantees that they are of legal age and have the legal capacity to contract. Dress Gallery may delete the Client's account at any time and for any reason at its sole discretion.

IV - Products

The products offered for sale are those described on the Site at the time the Client consults it, subject to stock availability. This information is updated in real time. However, errors in updating, regardless of origin, do not engage Dress Gallery’s responsibility. Consequently, Dress Gallery cannot be held liable for order cancellations due to stock shortages. Dress Gallery takes great care in the presentation and description of products to best inform the Client.

V - Orders

Order placement is subject to compliance with Dress Gallery’s procedures on the Site, including successive steps leading to order validation. The Client can select as many products as desired, which will be added to the "Cart". The Cart summarizes the chosen products, their prices, and related fees. The Client can modify the Cart before confirming the order. Confirmation of the order implies acceptance of the GTC, the products, prices, and associated fees. A confirmation email summarizing the order will be sent to the Client. The Client expressly accepts electronic communication for order confirmation. Invoices are available in the "My Account" section.

VI – Refusal to Process an Order

Dress Gallery reserves the right to remove any product at any time and to modify any content or information on the Site. Despite Dress Gallery’s best efforts, it may refuse to process an order after sending the confirmation email. Dress Gallery cannot be held liable towards the Client or third parties for withdrawing products, modifying content, or refusing orders after confirmation.

VII - Prices and Payment Methods

Customs duties and other taxes are not included in the price and must be paid directly by the Client to the carrier. Prices are indicated in euros for Europe and worldwide, VAT included but excluding customs duties and other taxes. Prices include the VAT applicable in France but may vary for other countries. Dress Gallery reserves the right to modify prices at any time but products are invoiced based on prices at order payment time, subject to availability. Products are payable in full at order. Payments are processed via the secure platform Stripe. Providing card details authorizes Dress Gallery to debit the account for the order amount. In case of payment failure, an order cancellation notification will be sent to the Client’s email.

VIII - Delivery

Deliveries are made by La Poste, UPS, or DHL from Monday to Saturday, depending on the option chosen by the Client. Delivery means physical transfer of products to the Client. Delivery fees are those stated on the Site at order time. Risk transfers to the Client upon handing the product to the carrier if the Client arranges transport. Delivery is made to the address indicated by the Client, which must be a residence or business. Delivery cannot be made to hotels or PO boxes. If delivery is impossible, Dress Gallery will attempt to leave the product in a secure place or return it to the warehouse. Delivery times are generally 15 working days in metropolitan France and 25 internationally, counted from the day after order validation. During December or after new collections launch, delivery times may extend by 10 days. Clients must provide accurate delivery details. Dress Gallery is not liable for delays not caused by it or due to force majeure. If delivery time is exceeded, the Client may request cancellation and refund within 14 days. Dress Gallery’s liability is limited to refund only.

IX - Refunds and Returns

You have 30 days from receipt to return any article not suitable for you. Items must be returned new, unworn, unwashed, with tags and original packaging. Returns not meeting these conditions will not be accepted or refunded. Please include your order number and reason for return. Return costs are borne by the Client. In case of Dress Gallery error (defective or wrong item), contact info@arizonalove.store immediately with a photo. After verification, refunds will be processed within 5 to 10 business days via the original payment method.

X - Warranties - Limitation of Liability

Dress Gallery’s liability concerning products purchased on the site is strictly limited to the purchase price of said products. In no case shall Dress Gallery be held responsible for any of the following losses, regardless of their origin:

  • Loss of income or sales

  • Operating loss

  • Loss of profits or contracts

  • Loss of anticipated savings

  • Loss of data

  • Loss of work or management time

  • Damage to one’s image

  • Loss of opportunity, including the opportunity to order a product

  • Moral damage.

The documents, descriptions, and information pertaining to the products appearing on the site are not covered by any warranty, whether explicit or implicit, except for legal warranties.

Dress Gallery does not provide any specific warranty for damages caused by computer viruses, worms, software bombs, Trojan horses, cancelbots, logical bombs, or any other form of computer programming routine designed to damage, destroy, or impair in any way the functionality of a computer or to interfere with its proper functioning, including any transmission arising from downloads made by the customer, their software, the site, or the server providing access to the site. In this regard, the customer acknowledges that they must install antivirus and security software on their hardware, as well as any other equipment protecting them from bugs, viruses, or other harmful programming routines. The customer agrees to bear all risks associated with downloaded content or content obtained through the use of the site and accepts responsibility for all damages caused to their computer system or any data loss resulting from such downloads.

Dress Gallery is only required to deliver products that meet the contractual provisions. The products are deemed compatible with the contractual provisions if the following conditions are met: (i) they must comply with the description and possess the characteristics presented on the site; (ii) they must be suitable for the purposes for which this type of product is usually intended; (iii) they must comply with the quality and durability criteria generally accepted for products of the same type and that can reasonably be expected.

Furthermore, Dress Gallery ensures that consumers are protected from the lack of conformity of products available for sale on the site under the following conditions:

APPARENTS DEFECTS: 

Apparent defects must be reported by email (info@arizonalove.store) within 3 business days of delivery, specifying the defect. Without this, no claim, return, or exchange is possible. Products must be returned in original packaging, unused and unwashed, with order references and claim copy to Dress Gallery’s headquarters after notification. Confirmed defects lead to either credit or product replacement within 14 days. Failure to follow return procedures voids exchanges or credits.

  • Art. L217-4 French Consumer Code: Seller delivers goods conforming to the contract and liable for defects present at delivery.

  • Art. L217-5: Goods conform if suitable for usual use and match description, public claims, or specific agreement.

  • Art. L217-7: Defects appearing within 24 months presumed to exist at delivery; 6 months for used goods.

  • Art. L217-8: Buyer cannot claim non-conformity for known defects.

  • Art. L217-9: Buyer chooses repair or replacement; seller may refuse if costs disproportionate.

  • Art. L217-10: If repair/replacement impossible, buyer can return goods for refund or partial refund.

  • Art. L217-11: Costs of these procedures borne by seller; does not prevent damages claims.

  • Art. L217-12: Actions expire 2 years from delivery.

  • Art. L217-13: Does not affect other contractual or legal actions.

  • Civil Code Articles 1641-1649: On hidden defects warranty.

FORCE MAJEUR: 

In case of force majeure preventing GTC execution, Dress Gallery will notify the Client within 15 days by email or registered letter. Force majeure includes strikes, riots, war, natural disasters, epidemics, transport blockages, legal restrictions, technical failures, and other uncontrollable events. Obligations are suspended during such events without compensation. If lasting more than 3 months, contract may be terminated without compensation. Client non-payment is not force majeure.

XII - Partial Invalidity

If any provision is invalid, the rest remain fully effective.

XIII - No Waiver

No tolerance or inaction by Dress Gallery shall be construed as waiver of rights under these T&Cs.

XIV - Governing Law and Jurisdiction

Sales are governed by French law. Disputes may be resolved by mediation or arbitration. Customers can use the European Commission’s online dispute resolution platform: http://ec.Europa.Eu/consumers/odr/. If no amicable settlement, disputes fall under competent French courts.
