DRESS GALLERY RESERVES THE RIGHT TO ADAPT OR MODIFY AT ANY ONE TIME THE SAID GTC. THE VERSION OF THE GTC WHICH APPLIES TO ANY SALE IS THE ONE THAT APPEARS ON THE SITE WWW.FURDELUXE.STORE AT THE TIME THAT THE ORDER IS PLACED. III â REGISTERING ON THE SITE

TO PLACE AN ORDER, THE CUSTOMER MUST FIRST REGISTER ON THE SITE BY CREATING AN ACCOUNT COMPRISED OF THE CUSTOMERâS INFORMATION (THE "ACCOUNT").
THE CUSTOMERâS REGISTRATION ON THE SITE WILL BE APPROVED BY DRESS GALLERY UPON VERIFICATION OF THE STANDARD FORM THEY SEND IN. THE CUSTOMER THEN RECEIVES A CONFIRMATION E-MAIL FOR THEIR REGISTRATION.
ONCE THE ACCOUNT IS CREATED, THE CUSTOMER MUST VERIFY THAT THE INFORMATION THEY PROVIDE IS ACCURATE AND COMPLETE. THE CUSTOMER IS ALWAYS REQUIRED TO UPDATE HIS PERSONAL INFORMATION. IN THE EVENT OF A MISTAKE IN THE WORDING OF THE RECIPIENTâS CONTACT INFORMATION, DRESS GALLERY SHALL NOT BE HELD LIABLE FOR ITS INABILITY TO DELIVER THE PRODUCTS.
BY REGISTERING ON THE SITE, THE CUSTOMER REPRESENTS AND WARRANTS TO DRESS GALLERY THAT THEY HAVE REACHED THE AGE OF MAJORITY AND HAVE LEGAL CAPACITY TO ENTER INTO CONTRACTUAL RELATIONS.
DRESS GALLERY IS ENTITLED TO DELETE THE CUSTOMERâS ACCOUNT AT ANY ONE TIME, FOR ANY GIVEN REASON, IN ITS SOLE DISCRETION.

V - ORDERS

ONCE AN ORDER IS PLACED ON THE SITE, IT IS SUBJECTED TO THE PROCEDURE IMPLEMENTED BY DRESS GALLERY ON THE SITE COMPRISING THE SEQUENTIAL STEPS LEADING UP TO CONFIRMATION OF SAID ORDER.
THE CUSTOMER CAN SELECT AD MANY PRODUCTS AS THEY DESIRE, WHICH WILL BE ADDED TO THEIR CART (THE "CART"). THE CART SUMMARIZES ALL PRODUCTS CHOSEN BY THE CUSTOMER AS WELL AS THE PRICES AND APPLICABLE CHARGES. THE CUSTOMER CAN EDIT THE CART AS THEY WISH BEFORE CONFIRMING THEIR ORDER. ONCE THE ORDER IS ACCEPTED, IT IS DEEMED THAT THE CUSTOMER HAS CONFIRMED AND ACCEPTED THE GTC, THE PRODUCTS PURCHASED, THEIR PRICE AS WELL AS ANY ASSOCIATED CHARGES.
A CONFIRMATION E-MAIL SUMMARIZING THE ORDER (PRODUCTS, PRICES, PRODUCT AVAILABILITY, QUANTITYâŠ) WILL BE SENT TO THE CUSTOMER BY DRESS GALLERY. IN THIS REGARD, THE CUSTOMER FORMALLY ACCEPTS THAT DRESS GALLERY WILL USE E-MAILS TO CONFIRM THE CONTENT OF THE ORDER. INVOICES ARE AVAILABLE IN THE « MY ACCOUNT » SECTION ON THE SITE.

VI â REFUSAL TO PROCESS AN ORDER

DRESS GALLERY RESERVES THE RIGHT TO REMOVE ANY AND ALL PRODUCTS APPEARING ON THE SITE AND TO REPLACE OR MODIFY ANY AND ALL CONTENT OR INFORMATION CONTAINED ON SAID SITE. DESPITE DRESS GALLERYâS BEST EFFORTS TO SERVE ITS CUSTOMERS, DRESS GALLERY MAY REFUSE TO PROCESS AN ORDER AFTER HAVING SENT THE CONSUMER A CONFIRMATION E-MAIL SUMMARIZING THE ORDER.
DRESS GALLERY SHALL NOT BE HELD LIABLE TO THE CUSTOMER OR A THIRD PARTY FOR DECIDING TO REMOVE A PRODUCT FROM THE SITE, OR FOR DECIDING TO REPLACE OR MODIFY ANY AND ALL CONTENT OR INFORMATION CONTAINED ON THE SITE, OR FOR REFUSING TO PROCESS AN ORDER AFTER HAVING SENT THE CONFIRMATION E-MAIL SUMMARIZING SAID ORDER.

VII â PRICES AND TERMS OF PAYMENT

CUSTOM DUTIES AND OTHER TAXES ARE NOT INCLUDED IN THE PRICE PAID BY THE CUSTOMER. THESE FEES MUST BE PAID BY THE CUSTOMER DIRECTLY TO THE CARRIER.
PRODUCT PRICES ARE MENTIONED ON THE SITE IN EUROS FOR EUROPE AND THE REST OF THE WORLD, VAT INCLUDED, BUT EXCLUDING CUSTOM DUTIES AND OTHER TAXES.
ALL PRICES APPEARING ON THE SITE INCLUDE THE VALUE-ADDED TAX (VAT) WHICH APPLIES IN FRANCE, WHICH MAY DIFFER DEPENDING ON THE COUNTRY OF INVOICE.
DRESS GALLERY RESERVES THE RIGHT TO MODIFY ITS PRICES AT ANY ONE TIME, BUT ITS PRODUCTS ARE BILLED BASED ON THE APPLICABLE RATES AFTER THE ORDER IS RECORDED AND PAID FOR, DEPENDING ON THEIR AVAILABILITY. THE PRODUCTS ARE PAYABLE IN FULL AT THE TIME OF THE ACTUAL ORDER.
PAYMENT FOR THE PURCHASES IS MADE THROUGH THE SECURED ONLINE PAYMENT PLATFORM OPERATED BY OUR PARTNER STRIPE. THE CUSTOMER EXPRESSLY ACKNOWLEDGES THAT COMMUNICATING THEIR CREDIT CARD NUMBER TO DRESS GALLERY AUTHORIZES THEIR ACCOUNT TO BE DEBITED OF THE PRICE OF THE ORDERED PRODUCTS. IF NEEDED, DRESS GALLERY WILL NOTIFY THE CUSTOMER THAT THE ORDER HAS BEEN CANCELLED FOR NON-PAYMENT BY E-MAIL, ON THE ADDRESS PROVIDED BY THE CUSTOMER WHEN THEY REGISTERED ON THE SITE.
THE DATA RECORDED AND SAVED BY DRESS GALLERY ARE PROOF THAT AN ORDER WAS PLACED AND OF ALL PURCHASES MADE. THE DATA RECORDED BY STRIPE ARE PROOF OF ALL THE FINANCIAL TRANSACTIONS THAT HAVE TAKEN PLACE BETWEEN THE CUSTOMER AND DRESS GALLERY.

VIII- DELIVERY
Â
DELIVERY IS ORGANIZED BY LA POSTE, UPS OR DHL, MONDAY THROUGH SATURDAY, DEPENDING ON THE OPTION SELECTED BY THE CUSTOMER UPON VALIDATION OF THEIR ORDER.
THE DELIVERY CONSISTS IN TRANSFERRING TO THE CUSTOMER PHYSICAL POSSESSION OF THE PRODUCTS (THE âDELIVERYâ).
THE DELIVERY CHARGES WHICH APPLY TO THE ORDER ARE THOSE MENTIONED ON THE SITE UPON PLACING THE ORDER IN "DELIVERY AND RETURNS".
BY WAY OF EXCEPTION, THE RISK IS TRANSFERRED TO THE CUSTOMER ONCE THE PRODUCT IS HANDED OVER TO THE CARRIER WHEN SAID CARRIER IS COMMISSIONED BY THE CUSTOMER AND NOT BY DRESS GALLERY.
THE DELIVERY SHALL BE MADE TO THE DELIVERY ADDRESS PROVIDED BY THE CUSTOMER, BEARING IN MIND THAT THIS MUST BE THE CUSTOMERâS RESIDENTIAL ADDRESS, OR THAT OF A NATURAL OR LEGAL PERSON OF THEIR CHOICE (DELIVERY MADE TO THEIR BUSINESS). DELIVERY CANNOT BE MADE TO HOTELS OR P.O. BOXES.
IN THE EVENT THAT THE DELIVERY CANNOT BE MADE AS PLANNED, DRESS GALLERY WILL MAKE EVERY EFFORT TO FIND A SECURE LOCATION TO DROP OFF THE PRODUCT. IF UNABLE TO DO SO, THE PRODUCT SHALL BE RETURNED TO DRESS GALLERYâS WAREHOUSE UPON RECEIVING THE PRODUCT.
DRESS GALLERY DELIVERS THE ORDERS WITHIN MAXIMUM 15 (FIFTEEN) BUSINESS DAYS FOR A DELIVERY TO METROPOLITAN FRANCE AND MAXIMUM 25 (TWENTY-FIVE) BUSINESS DAYS FOR INTERNATIONAL DELIVERY, THE DELAY BEING COUNTED DOWN FROM THE DAY AFTER ORDER CONFIRMATION. THE DAY AFTER A COLLECTION IS PLACED ONLINE AND THROUGHOUT THE MONTH OF DECEMBER, THE TIME OF DELIVERY MAY BE INCREASED BY AN ADDITIONAL 10 (TEN) DAYS, DEPENDING ON THE AMOUNT OF ORDERS RECEIVED.
SO AS TO OBSERVE THE AGREED DELIVERY TIME, THE CUSTOMER MUST MAKE SURE THEY HAVE PROVIDED ACCURATE AND COMPLETE INFORMATION CONCERNING THE DELIVERY ADDRESS (INCLUDING, IN PARTICULAR: STREET NO., BUILDING NO., STAIRCASE NO., ACCESS CODES, NAMES AND/OR NUMBERS ON THE INTERCOM, ETC.).
DRESS GALLERY SHALL NOT BE HELD LIABLE FOR A DELAY IN DELIVERY WHICH IS NOT A RESULT OF ITS PERSONAL ACT OR OF A CASE OF FORCE MAJEURE (AS DEFINED BELOW).
IN THE EVENT OF A DELAY IN DELIVERY, THE CUSTOMER MAY REQUEST AND OBTAIN CANCELLATION OF THE PURCHASE, INCLUDING ALL AMOUNTS PAID WHEN THE ORDER WAS PLACED, WITHIN A MAXIMUM 14 (FOURTEEN) DAYS OF MAKING SAID REQUEST. NOTWITHSTANDING THE AFOREMENTIONED, DRESS GALLERY IS NOT LIABLE FOR THE HARMFUL CONSEQUENCES DUE TO A LATE DELIVERY, AS ONLY THE PRODUCT CAN BE REIMBURSED BY DRESS GALLERY, EXCLUDING ALL OTHER FORMS OF COMPENSATION.

IX â REFUNDS AND RETURNS
A FAILURE BY THE CUSTOMER TO RESPECT THE PRESENT GTC SHALL PROHIBIT DRESS GALLERY FROM REFUNDING THE CONCERNED PRODUCTS. GIVEN THE SPECIFICITY OF THE PRODUCTS, NO HAND-MADE FUR ITEMS CAN BE RETURNED OR EXCHANGED UNLESS THE ITEM IS FLAWED (ACCEPTED ATTENTIVELY BY OUR TEAM). IN ANY CASE, RETURN FEES ARE CHARGED TO THE CUSTOMER, EVEN IF THE PRODUCT DELIVERED TO THE CUSTOMER IS DIFFERENT FROM THE ONE ORDERED OR IS DEFECTIVE. THE DOCUMENTS, DESCRIPTIONS AND INFORMATION PERTAINING TO THE PRODUCTS APPEARING ON THE SITE ARE NOT COVERED UNDER ANY WARRANTY, WHETHER EXPLICIT OR IMPLICIT, WITH THE EXCEPTION OF LEGAL WARRANTIES.
DRESS GALLERY DOES NOT PROVIDE ANY SPECIFIC WARRANTY FORANY DAMAGES CAUSED BY A COMPUTER VIRUS, WORMS, SOFTWARE BOMBS, A TROJAN HORSE, A CANCELBOT, A LOGICAL BOMB OR ANY OTHER FORM OF COMPUTER PROGRAMMING ROUTINE DESIGNED TO DAMAGE, DESTROY OR DETERIORATE IN ANY WAY THE FUNCTIONALITY OF A COMPUTER OR TO INTERFERE WITH SAID COMPUTERâS PROPER FUNCTIONING, MEANING ANY TRANSMISSION ARISING FROM ANY DOWNLOADS MADE BY THE CUSTOMER, FROM THEIR SOFTWARE, FROM THE SITE OR FROM THE SERVER WHICH PROVIDES ACCESS TO THE SITE. IN THIS REGARD, THE CUSTOMER ACKNOWLEDGES THAT THEY MUST INSTALL ANTIVIRUSES AND SECURITY SOFTWARE ON THEIR HARDWARE AS WELL AS ANY OTHER EQUIPMENT PROTECTING THEM FROM BUGS, VIRUSES OR OTHER HARMFUL SIMILAR PROGRAMMING ROUTINES. THE CUSTOMER AGREES THAT THEY MUST BEAR ALL RISKS ASSOCIATED WITH DOWNLOADED CONTENT OR OBTAINED THROUGH THE USE OF THE SITE AND AGREES THAT THEY ARE RESPONSIBLE OF ALL DAMAGES CAUSED TO THEIR COMPUTER SYSTEM OR OF ALL DATA LOSS AS A RESULT OF DOWNLOADING SAID CONTENT.
DRESS GALLERY IS ONLY REQUIRED TO DELIVER THE PRODUCTS MEETING THE CONTRACTUAL PROVISIONS. THE PRODUCTS ARE DEEMED COMPATIBLE WITH THE CONTRACTUAL PROVISIONS IF THE FOLLOWING CONDITIONS ARE MET: (I) THEY MUST COMPLY WITH THE DESCRIPTION AND POSSESS THE CHARACTERISTICS PRESENTED ON THE SITE ; (II) THEY MUST BE ADAPTED FOR THE PURPOSES FOR WHICH THIS TYPE OF PRODUCT IS USUALLY DESIGNED ; (III) THEY MUST COMPLY WITH THE QUALITY AND RESISTANCE CRITERION WHICH ARE GENERALLY ADMITTED FOR PRODUCTS OF THE SAME TYPE AND WHICH CAN GENERALLY BE EXPECTED.
FURTHERMORE, DRESS GALLERY ENSURES THAT THE CONSUMERS ARE PROTECTED FROM THE LACK OF CONFORMITY OF THE PRODUCTS AVAILABLE FOR SALE ON THE SITE UNDER THE FOLLOWING CONDITIONS
APPARENT DEFECTS
THE EXISTENCE OF AN APPARENT DEFECT MUST RESULT IN A CLAIM MADE BY E-MAIL (INFO@FURDELUXE.STORE) WITHIN THREE BUSINESS DAYS FOLLOWING THE DELIVERY. ALL CLAIMS MADE MUST EXPLICITLY INDICATE THE DEFECT IN QUESTION. FAILING THAT, NO CLAIMS SHALL BE TAKEN INTO CONSIDERATION, AND NO RETURNS OR EXCHANGES SHALL BE POSSIBLE. Â THE PRODUCT MUST BE RETURNED IN ITS ORIGINAL PACKAGING, IN ITS ORIGINAL CONDITION, NEW, UNWORN, WITH THE REFERENCES OF THE INITIAL ORDER AND A COPY OF THE CLAIM TO THE HEAD OFFICE OF DRESS GALLERY, AFTER HAVING SENT AN E-MAIL REPORTING THE APPARENT DEFECT OF THE CONCERNED PRODUCT. THE CASES OF APPARENT DEFECTS CONFIRMED BY DRESS GALLERY, DEPENDING ON THE CUSTOMERâS CLAIM, RESULT EITHER IN DRAWING UP A CREDIT NOTE FOR THE CUSTOMER, OR IN THE PRODUCT BEING REPLACED AND SENT BACK TO THE CUSTOMER WITHIN 14 DAYS. FAILING TO MEET THE RETURN PROCEDURE WILL MAKE IT IMPOSSIBLE TO OBTAIN A CREDIT NOTE OR TO EXCHANGE THE ITEM.
TO ALL INTENTS AND PURPOSES, ATTENTION MUST BE DRAWN TO THE FOLLOWING LEGAL PROVISIONS:
ART. L217-4 OF THE FRENCH CONSUMER CODE: âTHE SELLER MUST SUPPLY GOODS THAT ARE IN COMPLIANCE WITH THE CONTRACT AND MUST TAKE RESPONSIBILITY FOR DEFECTS EXISTING WHEN THE ITEM IS SUPPLIED. L217-5 OF THE FRENCH CONSUMER CODE: âIN ORDER TO COMPLY WITH THE CONTRACT, GOODS MUST: 1° BE SUITABLE FOR THE PURPOSE USUALLY ASSOCIATED WITH SUCH A PRODUCT AND, WHERE APPLICABLE (A) MATCH THE DESCRIPTION GIVEN BY THE SELLER AND HAVE THE QUALITIES THAT THE SELLER PRESENTED TO THE PURCHASER IN SAMPLES OR MODELS ;(B) HAVE THE QUALITIES A PURCHASER IS LEGITIMATELY ENTITLED TO EXPECT GIVEN THE PUBLIC DECLARATIONS MADE BY THE SELLER, THE MANUFACTURER OR ITS REPRESENTATIVE, PARTICULARLY IN ADVERTISING OR LABELING ; 2° OR FEATURE THE CHARACTERISTICS JOINTLY AGREED UPON BY THE PARTIES, OR BE SUITABLE FOR ANY SPECIAL USE REQUIRED BY THE PURCHASER AND BROUGHT TO THE SELLERâS ATTENTION AND ACCEPTED BY THE SELLER.â

L217-7 OF THE FRENCH CONSUMER CODE:Â âTHE LACK OF CONFORMITY WHICH BECOMES APPARENT WITHIN TWENTY-FOUR MONTHS FROM DELIVERY OF THE GOODS ARE PRESUMED TO EXIST AT THE TIME OF DELIVERY, UNLESS PROVED OTHERWISE. THE SELLER CAN REBUT THIS PRESUMPTION IF IT IS NOT COMPATIBLE WITH THE NATURE OF THE GOOD OR THE DEFECT INVOKED COMPLIANCE.â
ART. L217-8 OF THE FRENCH CONSUMER CODE:Â âTHE BUYER HAS THE RIGHT TO REQUIRE THE ITEM TO CONFORM TO THE CONTRACT. HOWEVER, HE CANNOT CHALLENGE COMPLIANCE BY INVOKING A DEFECT HE KNEW OF OR COULD NOT IGNORE WHEN HE BECAME A PARTY TO THE CONTRACT. THIS STIPULATION ALSO APPLIES WHEN THE DEFECT ORIGINATES FROM THE MATERIALS HE HIMSELF HAS SUPPLIED.â
